Puppy Sales Contract - Terms and Conditions
All puppies sold under this contract are sold in the best health possible. However, anytime a new puppy is bought and brought into your family, it is always a good idea to have it checked by your own Veterinarian (at your own expense) to ensure no oversights have been made and to provide the happiest, healthiest life possible for your new family member.
All sales are final unless the puppy is found to have a fatal illness.
Under this contract you have 48 hours, or the next business day to have the health of your puppy checked. If you choose not to do so, then the health portion of this contract is void and you take the puppy as is, with no guarantee.
If you take your puppy to have it checked and your Veterinarian finds a fatal problem, contact DixieLand Labradors immediately at one of the above listed numbers. You must be able to provide a signed statement from your Veterinarian explaining in detail what his findings are and if it is the direct result of any negligence on our part. We will then take the puppy and your Veterinarian's findings to our own Veterinarian for a final diagnosis. If our Veterinarian agrees with your Veterinarian's findings, we will then provide a replacement puppy of comparable pedigree from a mutually agreed upon litter as soon as one is available. You are responsible for all shipping charges associated with replacement puppy as well as all charges for the above mentioned Veterinarian visit. The original puppy must be returned (at your expense) before a new puppy can be given. No one may keep the original puppy. It must be returned to us and we will decide the puppy's future.
Size and color cannot be guaranteed upon replacement, only sex and this could sometimes be a lengthy process. However, it will be taken care of in as efficient a time frame as possible.
The breeder is NOT responsible for any veterinary bills the purchaser may incur regarding said puppy.
25 Month Guarantee
DixieLand Labradors is so confident in the dogs we raise and breed, we offer a 25 month guarantee. DixieLand Labradors hereby guarantees purchaser that our dogs will be free from Hip Dysplasia and Hereditary Eye defects during the first 25 months from the date of birth of the dog. If your dog is diagnosed with any of the above defects, the breeder will provide a replacement puppy with a comparable pedigree from a mutually agreed upon litter. In order to qualify for this guarantee, the following terms and conditions must be met:
1. DixieLand Labradors guarantees Hip Dysplasia and Hereditary Eye defects only. This guarantee does NOT cover any other ailments.
2. In the unlikely event you suspect your dog to have one of the below defects, the following procedures must be followed in order to quality for this guarantee:
Hip Dysplasia
1. If you suspect Hip Dysplasia, immediately notify your Veterinarian and arrange to have the dog's hips x-rayed. You must have your dog's hips x-rayed by 24 months of age (no later) but not before 1 1/2 years of age. This guarantee is void if Hip Dysplasia is found after the 25 months from the date of birth of the dog.
2. If Hip Dysplasia is detected by your Veterinarian, a copy of the x-rays must then be submitted to us for our Veterinarian to review. In addition, a copy of the x-ray must be submitted to the OFA at your expense and the OFA must find the dog to be "Severely Dysplastic".
3. The assessment provided by your Veterinarian must state with certainty that the Hip Dysplasia is indeed hereditary (genetic) and not the result of improper care on your part. Hip Dysplasia can also be caused by diet (over feeding) and too much exercise at a young age.
4. Upon review by our Veterinarian, a determination will be made as to the severity of the Hip Dysplasia. In the event that our Veterinarian determines that the Hip Dysplasia is severe and will impact the quality of life of the dog, the dog must be returned to us (at your expense) and we will decide what will be best for the dog's future. You may not keep the dog. We will then provide a replacement puppy with a comparable pedigree from a mutually agreed upon litter as soon as one is available. You are responsible for all shipping charges associated with replacement puppy as well as all charges for the above mentioned testing.
Hereditary Eye Defects
1. If you suspect Hereditary Eye Defects, immediately notify your Veterinarian and arrange to have the dog's eyes inspected. Your dog must be diagnosed by a Veterinarian that is a licensed member of the American College of Veterinarian Opthamologists. You must have your dog's eyes inspected by 24 months of age (no later) but not before 1 1/2 years of age. This guarantee is void if Hereditary Eye Defects are found after the 25 months from the date of the birth of the dog.
2. The assessment provided by your Veterinarian must state with certainty that the Eye Defect is indeed hereditary and not the result of an injury.
3. If a Hereditary Eye Defect is detected by your Veterinarian, a copy of the Veterinarian's assessment must then be submitted to us for our Veterinarian to review. In addition, a copy of the assessment must be submitted to the CERF at your expense. The CERF must also agree that the Eye Defect is indeed hereditary and not the result of an injury.
4. Upon review by our Veterinarian and the CERF, a determination will be made as to the severity of the Eye Defect. In the event that our Veterinarian and the CERF determine that the Eye Defect is severe and will impact the quality of life of the dog, the dog must be returned to us (at your expense) and we will decide what is best for the dog's future. You may not keep the dog. We will then provide a replacement puppy with a comparable pedigree from a mutually agreed upon litter as soon as one is available. You are responsible for all shipping charges associated with replacement puppy as well as all charges for the above mentioned testing.
Other Conditions
1. This contract is void if the dog is given or sold to another party without our express permission.
2. In the event that you decide not to keep your dog for any reason, DixieLand Labradors must be contacted immediately.
3. From time to time, DixieLand Labradors "rescues" animals that are not an integral part of our breeding program. This guarantee DOES NOT pertain to these dogs.
By signing this contract, you agree to all terms and conditions listed in its contents. It is the intention of this contract to protect the interest of the Breeder and Purchaser.
